Good morning:

I'd like to update you all on what has been transpiring of late with not only our community, but several other local Ryland developments. There was a meeting last night at Ryland's "The Cove" development at which I, and 3 other development representatives met and interviewed the first of 4 possible attorney's that as a whole group we could use to represent, and push forth our interests.

We will be interviewing the other 3 attorney's during the next 7-10 days and based upon our combined results, will agree on the actual one to use, and then we individually will be making a presentation to each of our developments. The goal here is to have a large and unified front that is represented by an experienced legal professional.

I want to stress that if anyone decides to participate in any possible "class action suit" that it will be on a voluntary basis! No one has to participate if they do not want too.

My role here as I was volunteered by others to represent Summerport, is to attend the attorney interviews, and along with the other 3 reps., to ask specific questions on how they would handle any possible action, to discuss and agree with these reps. who based on these interviews we feel will represent us as homeowners the best, and to then inform you as a whole, and to detail our decision. We all have to some extent or another suffered damage to our homes, and many aren't sure what to do, or how to go about the repair process, who exactly is responsible, etc... I'm hopeful that by having a true and experienced professional guiding and representing us , that individually we all will have what ever needed and required damages not only fixed, but the cause(s) of the damage also repaired.

If anyone has any comment, idea's, suggestions, please me know. Also, if anyone else would like to take on my "representative" role, PLEASE let me know as soon as possible as I have no problerm letting someone else take this position over.

Lastly, since I do not have all Summerport residents emails on this type of a distribution list, can you all kindly check with your neighbors and inform them of this update, and if they also want to be put on the master email list, to have them send me their email address.

Follow-up Email from 09.30.04

I forgot to add in today's earlier email that either individually, and/or after we have legal council chosen, the idea is to approach Ryland Homes directly with our compiled damage reports as done by hired inspector/engineers, and to give Ryland the opportunity to voluntarily come in and repair the listed damage(s). This is not a rush to immediate legal action, but the first step in a complicated matter.
